These Terms apply to sales of Products by A-elektronik d.o.o. to consumers through our webshop and through direct sales channels (such as email, telephone, written quotation, proforma invoice, payment link or another distance/direct ordering channel that we use). If you purchase as a business, please request our B2B terms.

Any product-specific or order-specific details stated at checkout, in our written quotation, in a proforma invoice or in an order confirmation form part of the Contract and prevail over these Terms only to the extent of a direct inconsistency.

Quick reference – after-sales process:

  1. Contact support@a-elektronik.hr first for withdrawal, return, wrong item, transit damage, defect, warranty or any other return/service request.
  2. Wait for our written instructions and, if issued, your RMA number.
  3. Ship goods back only as instructed. This is an administrative routing process and does not limit mandatory consumer rights.

I. General

1. Definitions

“Terms” – these Terms & Conditions of Sale (B2C).

“Seller / We / Us” – A-elektronik d.o.o.

“Buyer / You” – the consumer purchasing Products for personal use and not mainly for business, trade, craft or profession.

“Products” – AL brand products and related accessories or services offered by us.

“Order” – your webshop order or your request to purchase through a direct sales channel.

“Contract” – the consumer sales contract concluded under clause I.2.

“Courier” – the carrier selected by us for shipment unless otherwise agreed.

“Support email” – the support email address stated in the header of these Terms.

“Sales email” – the sales email address stated in the header of these Terms.

2. Product listings, quotations and contract conclusion

2.1 Product listings, catalogues and quotations are an invitation to treat unless we expressly state that they are binding.

2.2 Submitting an order through the webshop is your offer to buy.

2.3 In a direct sale, your acceptance of our quotation, your request to buy, or your payment against our proforma invoice or other payment request is treated as your request to purchase, subject to our acceptance.

2.4 The Contract is concluded when we send an order confirmation or other written acceptance, or when we dispatch the Products, whichever occurs first.

2.5 We may refuse or cancel an order before dispatch for stock unavailability, pricing or data error, failed verification, export/compliance issue, suspected fraud, or another legitimate reason. If we cancel after receiving payment, we will refund the amount paid.

3. Local retailers and distributors

3.1 Where appropriate and before a Contract is concluded, we may direct an enquiry to an authorised local retailer or distributor. This does not affect an already confirmed order unless you agree otherwise.

II. Prices, payment and delivery

1. Prices, VAT, taxes and delivery charges

1.1 Prices are shown in EUR.

1.2 For consumer sales within the EU, prices shown to consumers include VAT unless clearly stated otherwise.

1.3 For shipments outside the EU, prices may be shown without Croatian VAT where lawful. Import VAT, customs duties and similar charges in the destination country are borne by you unless we expressly state otherwise.

1.4 Delivery charges are shown before you place the order, or in our written offer, proforma invoice or other direct-sale document.

1.5 The price and delivery charge applying to your order are those shown or confirmed at the time you place the order or accept our offer.

2. Order checks and limits

2.1 The maximum order value per single purchase is €5,000. We may also apply export minimums, address verification or additional verification to help prevent fraud and comply with law. Orders exceeding this limit will not be processed automatically; please contact us if you wish to place a larger order.

2.2 We may place an order on hold or cancel it pending verification. If we cancel after payment, we will refund the amount paid.

3. Payment

3.1 Available payment methods are shown at checkout or offered by us in the direct-sale process.

3.2 Your order is processed once payment has been authorised and any required verification has been completed.

3.3 Payment card details are processed by our payment provider or bank and are not stored on our webshop systems.

4. Dispatch and delivery

4.1 We ship using the Courier of our choice unless otherwise agreed.

4.2 For orders received before 12:00 noon CET/CEST, we use reasonable efforts to dispatch within 1 working day after payment approval. For orders received after 12:00 noon CET/CEST, we use reasonable efforts to dispatch within the next 2 working days after payment approval.

4.3 Delivery to remote areas may take longer.

4.4 Delivery is made to the address shown at checkout or confirmed in the direct-sale process.

4.5 After order confirmation we may not be able to modify the order or delivery address, although we will try if you contact us promptly.

5. Tracking, failed delivery and re-shipment

5.1 We will send a dispatch notice and, where available, tracking details.

5.2 You should ensure that someone is available to receive the parcel where the Courier requires delivery attendance or signature.

5.3 If delivery fails and the parcel is returned to us, additional delivery charges may apply if you ask us to re-send it.

6. Shipment insurance and transfer of risk

6.1 We insure each package during transit until it is delivered.

6.2 Risk of loss passes to you when you, or a person designated by you, acquires physical possession of the Products.

6.3 If you arrange your own carrier that is not offered by us, risk passes when we hand the Products to that carrier.

III. Product use and technical notes

1. Specialised technical products / suitability

1.1 AL products are specialised technical products. You are responsible for ensuring that the Products are suitable and lawful for your intended use, installation and operation, and for following all manuals, safety instructions and applicable laws.

2. Programming, installation and configuration

2.1 Except to the extent mandatory law provides otherwise, we are not responsible for issues caused by programming, installation, configuration, misuse, modification or integration carried out by you or by third parties not authorised by us.

3. Product information and specifications

3.1 Product descriptions, documentation, specifications and part numbers may be updated from time to time because of improvements or other reasons. This does not affect your mandatory consumer rights or the specifications of an already confirmed order except where a lawful change is required or agreed.

IV. Legal rights, commercial warranty and liability

1. Statutory consumer rights

1.1 If you are a consumer, you have statutory rights if the Products are not in conformity with the Contract. These rights apply independently of any commercial warranty and cannot be excluded or limited by these Terms.

2. How to report a defect or non-conformity

2.1 If you believe a Product is defective, damaged, not as described or otherwise non-conforming, contact the Support email with your order number, product details, serial number if available, and a short description of the issue. Photos or video are helpful where available.

2.2 We may first suggest troubleshooting and may then issue return instructions and, if applicable, an RMA number.

3. Remedies for non-conformity

3.1 Where applicable law provides, you may be entitled to repair or replacement and, where conformity cannot be achieved or where otherwise provided by law, to a proportionate price reduction or termination of the Contract / refund.

4. Commercial warranty

4.1 Where a commercial warranty is offered for Products purchased directly from us, the warranty period is 3 years from the date of sale to you unless a longer period is expressly stated on the product page or in documentation supplied with the Product.

4.2 Please keep your invoice or proof of purchase for any warranty service request.

4.3 Any commercial warranty is additional to, and does not replace or reduce, your statutory consumer rights.

5. Limitation of liability

5.1 Nothing in these Terms limits or excludes liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud, wilful misconduct, gross negligence where applicable, product liability, or mandatory consumer rights and remedies.

5.2 Subject to clause 5.1 and to the extent permitted by law, we are not liable for indirect or consequential losses such as loss of profit.

5.3 Any limitation or cap applies only to the extent permitted by mandatory consumer law.

5.4 Subject to clause 5.1, our total aggregate liability to you in connection with any order shall not exceed the price you paid for the specific Product(s) giving rise to the claim. This cap does not apply to liability that cannot lawfully be limited.

V. Customer support, returns, withdrawal and complaints

1. One contact point, prior approval and RMA

1.1 For withdrawal, return, exchange, wrong item, transit damage, defect, warranty request or any other return/service issue, contact the Support email first.

1.2 Do not send Products back before receiving our written instructions.

1.3 We may issue an RMA number and return instructions. If an RMA number is issued, you must quote it and follow our instructions.

1.4 Parcels sent without prior approval or not following our instructions may be refused, returned to sender or processed with delay.

1.5 This is an administrative routing process only and does not limit any mandatory consumer right or remedy.

2. Right of withdrawal for distance sales

2.1 If you buy as a consumer through our webshop or another distance/direct sales channel, you may withdraw from the Contract within 14 days without giving any reason, unless a legal exception applies.

2.2 The withdrawal period expires 14 days from the day on which you, or a third party designated by you other than the carrier, acquires physical possession of the goods. If goods from one order are delivered separately, the period runs from the day you acquire physical possession of the last good.

2.3 To exercise the right of withdrawal, send an unequivocal statement to the Support email or by post to our address stated in the header. You may use the form in Appendix A, but it is not mandatory.

3. Return of goods after withdrawal

3.1 After notifying us of withdrawal, return the goods without undue delay and no later than 14 days from the day you informed us of your decision, unless we agree otherwise.

3.2 Please wait for our written instructions and, if issued, your RMA number before shipping the goods back.

4. Refunds after withdrawal

4.1 If you withdraw lawfully, we will refund all payments received from you, including standard delivery costs, within 14 days from the day we are informed of your decision to withdraw.

4.2 We may withhold the refund until we receive the goods back or you provide evidence that you have sent them back, whichever occurs first.

4.3 Refunds are made using the same payment method that you used, unless we agree otherwise.

5. Return shipping costs and condition of returned goods

5.1 You bear the direct cost of returning the goods after a lawful withdrawal unless the return is due to our error, non-conformity, transit damage or we agree otherwise.

5.2 You are liable only for diminished value resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the goods.

6. Exceptions to the right of withdrawal

6.1 The right of withdrawal does not apply where a legal exception applies, such as custom-made or clearly personalised goods, sealed goods not suitable for return for health or hygiene reasons once unsealed, and other categories clearly identified at the time of purchase where applicable law permits exclusion.

7. Written consumer complaints

7.1 Consumers may submit a written complaint by post or by email to the Support email.

7.2 We will confirm receipt of the written complaint without undue delay in writing.

7.3 We will respond in writing within 15 days from receipt, clearly stating whether we accept the complaint.

7.4 We keep records of written consumer complaints on a durable medium for at least 1 year from receipt.

8. Out-of-court resolution

8.1 We encourage you to contact us first so that we can try to resolve the matter directly. If we cannot resolve it, you may use competent out-of-court dispute resolution or other remedies available under applicable law.

VI. Information, intellectual property, data and law

1. Intellectual property

1.1 The Products, software, firmware, documentation, branding and related designs remain our property or the property of our licensors. The sale of a Product does not transfer any intellectual property rights except the limited right to use the Product for its ordinary intended purpose.

1.2 You may not reproduce, copy, distribute, reverse engineer or seek registration of our products, designs or branding, except to the extent mandatory law expressly permits otherwise.

2. Errors and omissions

2.1 Website, documentation and communication may occasionally contain clerical, typographical or similar errors. This does not affect your mandatory consumer rights.

3. Import / export and lawful use

3.1 You must comply with applicable import, export, installation, operation and product-use laws and restrictions in your jurisdiction.

4. Personal data

4.1 We process personal data for order handling, delivery, customer support, returns, warranty service, fraud prevention and legal compliance in accordance with our Privacy Policy.

5. Governing law and mandatory consumer protections

5.1 These Terms and any Contract are governed by Croatian law, without prejudice to any mandatory consumer protection provisions of the country in which you have your habitual residence.

5.2 Nothing in these Terms deprives a consumer of rights to bring claims before courts or other bodies available under applicable mandatory law.

5.3 The application of the United Nations Convention on Contracts for the International Sale of Goods (CISG) is excluded.

VII. General provisions

1. Severability

1.1 If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall continue in full force and effect.

2. Assignment

2.1 You may not assign or transfer your rights or obligations under the Contract without our prior written consent. We may assign or subcontract any of our rights or obligations without notice to you, provided this does not reduce your rights under these Terms or under mandatory law.

3. Waiver

3.1 No failure or delay by us in exercising any right under these Terms shall operate as a waiver of that right, nor shall any single or partial exercise preclude any further exercise of that or any other right.

4. Entire agreement

4.1 These Terms, together with any order confirmation and product-specific conditions, constitute the entire agreement between you and us relating to the Products. No variation of these Terms is effective unless agreed in writing by both parties.

Appendix A – Return / Withdrawal / Service Request Form

You may use this form to notify us of a withdrawal, return or service request. It is optional – a plain email or letter with an unequivocal statement is also sufficient.

Important: please do not ship the goods until you receive our written instructions and, if issued, your RMA number.
